1.Agreeing to these Terms

These Terms of Service (“Terms”) are an agreement between you and Jake Amaral (“Plotluck,” “we,” “us”). They cover the Plotluck website, game, and related services (the “Service”).

By hosting or joining a game, or subscribing, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2.Who can use Plotluck

  • You must be at least 13 years old to play or host.
  • If you're under the age of majority where you live (18 in most US states), you need a parent or guardian's permission.
  • You must be at least 18 and able to form a binding contract to subscribe to Plotluckier.

3.What Plotluck is

Plotluck is a party game. A host opens a room on a shared screen, players join from their own devices, fill in blanks, and play mini-games built from a story written from their answers. Hosting is free within the limits shown on our pricing page (currently up to 3 games a day); Plotluckier removes those limits. Players never pay.

The Service is provided for personal, non-commercial entertainment. Features, story packs, and free-plan limits may change; we'll give Plotluckier subscribers notice of changes that reduce what their plan includes.

4.Playing nicely

Plotluck is for laughing with people, not at them. Don't use it to:

  • harass, threaten, bully, or demean anyone, including other players and people named in answers;
  • post hate speech, sexual content involving minors, or content that promotes violence, self-harm, or illegal activity;
  • share anyone's personal information, including your own;
  • impersonate someone, or present AI-written stories as statements of fact about real people;
  • join rooms you weren't invited to, disrupt games, or try to get around the game's safety checks or limits;
  • access the Service with bots or scrapers, overload it, probe its security, or reverse engineer it except where the law allows.

We may filter, replace, or remove content, and remove people from games or the Service, when these rules are broken.

5.Your content

You keep whatever rights you have in what you type: nicknames, answers, endings, and plans (“your content”). You give us a worldwide, non-exclusive, royalty-free license to use your content to run the Service: to show it to the players in your room, send it to our AI provider to write your story, check it for safety, and, if the host shares a story, display that story at its link until it expires. The license ends when your content is deleted.

You're responsible for what you type and confirm you have the right to share it. If you send us feedback or ideas, we may use them without any obligation to you.

6.AI-written stories

Stories, bonus endings, perils, and the Judge's verdicts are written by AI from players' answers. They're fiction, often absurd, and not statements of fact about anyone, including real people named in answers. We check AI output against our content rules before it's shown, but no check is perfect, and the AI can produce text that's strange, inaccurate, or not to your taste. The host can swap any story for its hand-written version at any time.

7.Hosts

The host chooses the room's content rating and is responsible for running the game appropriately for the people playing and watching, including removing players who break these Terms. If you stream, record, or broadcast a game, you're responsible for that content and for having permission from the people in it.

8.Accounts

Playing doesn't require an account. Plotluckier subscribers have one:

  • Give us accurate information, keep your password secure, and don't share your account. You're responsible for activity under it.
  • Tell us right away at [hello@yourdomain.com] if you think someone else has accessed your account.
  • You can ask us to delete your account at any time; cancel your subscription first so you're not charged again.

9.Plotluckier subscriptions and billing

  • Plotluckier costs $4.99 per month (US dollars), plus any applicable taxes. What it includes is shown on our pricing page and before you pay.
  • Plotluckier renews automatically each month and charges your payment method on file at the then-current price until you cancel. You authorize these recurring charges when you subscribe.
  • Cancel anytime online in your account. Cancellation stops future charges and takes effect at the end of the month you've paid for; you keep Plotluckier until then.
  • Refunds: payments are non-refundable and we don't give credit for partial months, except where the law requires it. If you were charged in error, email [hello@yourdomain.com] within 30 days and we'll make it right.
  • Price changes: we'll email you at least 30 days before a price change takes effect, so you can cancel first. A new price applies from your next billing period.
  • Payments are processed by Stripe. We don't receive or store your full card number.
  • If a payment fails, we may retry it and may pause Plotluckier until it succeeds.
  • Promotional or free periods, if we offer them, renew at the regular price unless you cancel before they end, and we'll say so when you sign up.

10.Our content

The Service, including its software, story templates, characters, artwork, and branding, belongs to us and our licensors and is protected by intellectual property laws. We give you a personal, revocable, non-transferable license to use it as these Terms allow. “Plotluck” and our logo are our trademarks.

12.Suspension and termination

You can stop using the Service at any time. We may suspend or end your access if you break these Terms, if the law requires it, or to protect the Service or other people. If we end a paid subscription for a reason other than your breach of these Terms, we'll refund the unused part of the current month. Sections that by their nature should survive termination (such as disclaimers and limits of liability) survive.

13.Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Service will be uninterrupted or error-free, that a game in progress won't be lost (for example during maintenance), or that AI-written content will meet your expectations.

14.Limitation of liability

To the fullest extent the law allows, we won't be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not all apply to you.

15.Indemnification

You agree to defend and indemnify us against claims arising from your content, your misuse of the Service, or your violation of these Terms, to the extent the law allows.

16.Governing law and disputes

These Terms are governed by the laws of Florida, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at [hello@yourdomain.com] and try to resolve it informally for 30 days. Disputes that aren't resolved will be decided in the state or federal courts located in Gainesville, Florida, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small-claims court instead.

17.Changes to these Terms

We may update these Terms. The date at the top shows the current version. If a change is material, we'll give Plotluckier subscribers at least 30 days' notice by email. Continuing to use the Service after a change takes effect means you accept it.
